Terms of Use

These terms apply to everyone who uses proqmed.com and the ProQmed portals for surgeons, hospital management, implant companies, warehouses, patients and independent practitioners (together, “ProQmed”). By using ProQmed you agree to these terms. If you do not agree, please do not use ProQmed.

ProQmed is a coordination platform. It helps the people involved in a surgical implant case share information, book cases, confirm and track orders and follow cases through to payment. ProQmed does not supply implants, perform procedures or provide medical care.

When you use ProQmed you agree to:

  • give accurate information and keep it up to date;
  • keep your sign-in details private and tell us straight away if you think someone else has used your account;
  • only use the portal for the role your account was set up for;
  • only access patient information you are entitled to see for that patient’s care;
  • not misuse, copy, disrupt or try to gain unauthorised access to ProQmed or other users’ information.

Each user remains responsible for their own professional decisions and obligations, including clinical decisions, procurement rules, pricing, delivery and payment agreed between hospitals, surgeons and implant companies.

We may suspend or close an account that breaks these terms or puts other users or patients at risk.

2

Privacy & POPIA

We process personal information in line with the Protection of Personal Information Act, 2013 (POPIA). We only collect what we need to run ProQmed.

What we collect:

  • account details such as your name, role, email address, phone number, hospital or company;
  • case information entered by users, which can include patient details, procedure information and implant usage;
  • basic technical information needed to keep you signed in and keep the service secure.

How we use it: to run your account, share case information with the people involved in that case, provide support, keep ProQmed secure and improve the service. We do not sell personal information.

Who can see it: only the users involved in a case (for example the surgeon, the hospital and the implant company supplying it) and our service providers who host and operate ProQmed on our behalf under confidentiality obligations. Patient information is treated as special personal information and access is limited accordingly.

Your rights: you may ask to see, correct or delete your personal information, or object to how it is used, by emailing us. You also have the right to lodge a complaint with the Information Regulator of South Africa.

Implant company profiles & marketing

This section applies to implant companies, suppliers and distributors, and to the representatives and managers who act for them (“implant companies”), when they create, complete or update a company profile on ProQmed, including through the company onboarding form.

Permission to use your logo and profile. By creating or submitting a company profile, the implant company gives ProQmed a non-exclusive, royalty-free licence, for as long as the profile is on ProQmed, to use, reproduce, display, resize, format and publish its company name, logo and trade marks, product names and images, company and product descriptions, and other details provided in its profile:

  • on proqmed.com, the ProQmed portals and the documents ProQmed produces, such as case documents, booking lists and PDFs;
  • in ProQmed’s marketing and promotional material in any format, including the website, social media, presentations and demonstrations, brochures, emails and newsletters, and material for hospitals, surgeons, partners and investors;
  • to identify the implant company as a company that is listed on, available on or uses ProQmed.

Your promises. The implant company confirms that it owns, or is authorised to license, everything it adds to its profile; that ProQmed’s use of it as described here will not infringe anyone else’s rights or break any law or regulation, including advertising and medical device rules; and that the information is accurate and kept up to date. The implant company remains responsible for its own product information, pricing and regulatory registrations.

No endorsement. Showing an implant company’s name or logo does not mean ProQmed endorses that company or its products, or that the company endorses ProQmed, and it does not create a partnership, agency or exclusive arrangement.

Ownership. The implant company keeps ownership of its own name, logo and trade marks. ProQmed keeps ownership of the ProQmed platform, name and logo.

Indemnity. The implant company indemnifies ProQmed against any claim, loss or cost arising from content it supplies or from a breach of this section.

Stopping marketing use. An implant company can ask ProQmed to stop using its logo in new marketing material by emailing us. ProQmed will stop new use within 30 days. Material already published, printed or distributed before then does not need to be withdrawn, and this does not affect how the company’s profile is shown inside ProQmed while it remains listed.

4

Medical disclaimer

ProQmed does not provide medical advice, diagnosis or treatment. Information in the Patient portal is shared by your care team for your convenience and does not replace speaking to your surgeon or hospital.

Implant and product information on ProQmed is provided by implant companies. Always confirm product suitability, availability and regulatory approval with the supplier before use.

5

Independent listings & third parties

Anaesthetist and theatre assistant listings, Professional Opportunities Board profiles and requests are submitted by independent users. ProQmed does not vet, employ or endorse them. Please verify registration, qualifications and terms directly before engaging anyone.

Some features link to outside services, such as the WhatsApp group used to help identify implants. Those services have their own terms and privacy policies, and ProQmed does not control or monitor what is posted there.

6

Cookies

ProQmed uses essential cookies to keep you signed in and to keep the service secure. We do not use advertising cookies.

7

Availability & liability

We work hard to keep ProQmed available and accurate, but it is provided “as is” and we cannot guarantee it will always be uninterrupted or error-free. Always have a backup plan for time-critical cases.

To the extent permitted by South African law, ProQmed is not liable for indirect or consequential loss arising from use of the platform, or for the acts or omissions of other users, suppliers or third-party services.

We may update these terms from time to time. The date at the top of this page shows when they last changed, and continuing to use ProQmed means you accept the updated terms. These terms are governed by the laws of the Republic of South Africa.
